Tabiara — Terms and Conditions

1. Seller and scope

These Terms and Conditions apply to purchases of digital content from Tabiara, operated by:

“Our”, “we” and “us” refer to this seller.

Our products include downloadable travel guides, e-books, travel planners, maps, worksheets and related digital materials. The applicable product description identifies what is included in your purchase.

These terms cover one-time purchases of digital content. Any separately offered subscription, physical product or individually provided service requires the additional terms disclosed for that offering.

Mandatory consumer rights remain unaffected by these terms.

2. Product information and technical requirements

Before ordering, please review the product description, including the language, destination, edition, file formats, included files, functionality and technical requirements.

You need a compatible device, sufficient storage and software capable of opening the advertised file formats. Internet access is required to place an order and download the files. External links, online maps and third-party services may require an internet connection even where the downloaded product itself can be used offline.

Any material compatibility restrictions, access limitations or technical protection measures will be disclosed before purchase.

A product includes only the languages and files expressly listed in its description. Selecting a different shop language does not automatically change the language of a product.

3. Ordering and formation of the contract

Product listings invite you to submit an order.

You may review and correct your selection and details before submitting the order. By selecting the final purchase button, which clearly indicates an obligation to pay, you submit a binding offer to purchase the selected products.

We accept your offer by sending an email expressly confirming acceptance or by making the purchased digital content available to you, whichever occurs first. An automated acknowledgment that merely confirms receipt of your order does not itself constitute acceptance unless it expressly states otherwise.

If we cannot accept your order, we will inform you and refund any payment already received for that order.

4. Contract language and records

Contracts may be concluded in English, German or Spanish, depending on the language offered and selected during checkout.

We send the order details, applicable contractual terms and required consumer information by email in a form you can retain. Please save these documents.

The version accepted when you place your order applies to that purchase. Later amendments do not retrospectively change an existing contract without a lawful basis.

5. Prices, taxes and payment

The currency and amount payable are displayed before you submit your order.

For customers in Germany and other EU consumer markets, displayed consumer prices include applicable VAT where legally required. Any US sales tax that we are required to collect will be disclosed before the order is placed.

No physical shipping charges apply to products delivered exclusively by download.

Your payment provider may charge separate currency-conversion or other fees under its agreement with you.

Available payment methods are displayed during checkout. Payment is due when the contract is concluded, unless a different arrangement is expressly shown before purchase.

6. Delivery of digital content

Digital content is supplied by download link, delivery email or the access method identified on the product page.

For products advertised as immediately available, delivery takes place without undue delay after successful payment and, where required, your express consent to delivery during the withdrawal period.

Where an applicable withdrawal right exists and you do not request immediate delivery, we will make the content available after the withdrawal period has expired. Any different delivery date, including for pre-orders, will be disclosed before purchase.

If your download is missing or does not work, contact support@stifo.de.

Any contractual limits on download availability will be disclosed before purchase. Such limits do not restrict statutory rights to supply, conformity or remedies.

7. Licence and permitted use

Unless the product description expressly grants a broader licence, payment gives you a non-exclusive licence to use the purchased files for your own private, non-commercial purposes.

You may:

• Download and store the files on devices you personally use.
• Make reasonable backup copies.
• Print copies for your own use.
• Edit files expressly supplied as editable planners or templates.
• Share your completed personal itinerary with people travelling with you, provided this does not distribute the original product or a substantial substitute for it.

You may not resell, sublicense, publicly upload, distribute or commercially exploit the original files or substantial parts of them without permission.

Sharing download links, placing the files in publicly accessible folders or distributing the original products to a group is not included in a single-user licence.

Statutory exceptions and limitations, including applicable quotation rights and fair use, remain unaffected. Any separately identified third-party or open-source material remains subject to its applicable licence.

8. Travel information and third-party services

Tabiara supplies informational and planning materials. Purchasing these materials does not book transport, accommodation, activities or other travel services.

Prices, opening hours, transport schedules, entry requirements, accessibility information and local conditions may change. Check time-sensitive information with the relevant official authority or service provider before relying on it.

Routes and maps are planning aids. Follow local signs, access restrictions and current safety information.

If you book a service through an external provider, your booking contract is with that provider unless we expressly state otherwise.

These provisions do not exclude our responsibility for providing digital content that conforms to the contract and applicable law.

9. Withdrawal and refunds

Where you have a statutory right of withdrawal, the Withdrawal Policy below applies.

For digital content supplied without a physical medium, that right may expire after delivery begins only when the applicable legal requirements have been met. Merely purchasing a digital product or accepting these terms does not automatically remove your withdrawal rights.

Our Refund Policy explains how to report delivery problems and request available remedies.

10. Conformity, defects and updates

You retain all applicable statutory rights where content is not supplied, is defective or does not conform to the contract.

Depending on the applicable law and circumstances, these rights may include requiring supply or correction, a price reduction, termination of the contract, reimbursement or damages.

We provide updates, including security updates, where required by law, and inform you about their availability and any relevant installation requirements.

A one-time purchase does not include an unlimited subscription to new editions or continuously revised travel information unless expressly advertised. This does not limit any legally required updates or remedies.

Please contact support@stifo.de with a description of the problem. Providing an order number and relevant technical details helps us investigate, but we do not make statutory rights conditional on unnecessary formalities.

11. Liability

Our liability is governed by applicable law.

Nothing in these terms excludes or limits liability for intent, gross negligence, injury to life, body or health, fraudulent concealment, an expressly assumed guarantee, mandatory product liability or any other liability that cannot lawfully be excluded or restricted.

12. Applicable law and courts

German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.

This choice does not deprive consumers of mandatory protections available under the law of their habitual residence where those protections apply.

Jurisdiction is determined by applicable law. These terms do not require consumers to bring claims exclusively before German courts.

Nothing in these terms prevents you from contacting a consumer protection authority, using an available statutory complaint procedure or bringing proceedings before a competent court.

Tabiara — About Our Travel Information

Tabiara creates digital materials to help you explore destinations and organise your own travel.

Our guides, stories, planners and maps are informational products. They do not include reservations, tickets, transport, accommodation or guided services unless a product expressly states otherwise. Our Products were generated using AI for texts, image generation (non-realistic and realistic looking like photos and images) as well as further content.

Check current information

Travel information can change after publication. Before visiting or booking, check relevant details directly with official authorities and service providers, particularly:

• Passport, visa and entry requirements.
• Health requirements and official travel advice.
• Opening hours, admission prices and reservation requirements.
• Transport timetables and route availability.
• Accessibility, local restrictions and weather conditions.

Routes and personal safety

Suggested routes and activities are planning ideas. Consider your circumstances, abilities, equipment and current local conditions.

Follow official instructions, signs and access restrictions. Do not rely on a travel planner or illustrative map as an emergency or safety-critical navigation system.

Stories and illustrations

Where a product is identified as fiction, its characters and narrative events may be invented. Narrative scenes and illustrative images are not representations that a particular event, service or location feature currently exists.

Any fictional or illustrative element does not change the factual product features expressly promised in the product description.

External providers

External websites and booking services are operated by their respective providers. Check their current information, terms and privacy policies before using them.

Your statutory rights concerning the quality and conformity of our own products remain unaffected.
